OFFICE MEMORANDUM

Subject :     Modified Assured Career Progression Scheme for the Central Government Civilian Employees - Clarification regarding.

     A joint committee is set up to examine the anomalies pertaining to the Modified Assured Career Progression Scheme (MACPS) vide Department of Personnel & Training O.M.No.11/1/2010-JCA dated 03-05-2010.

2.      During the joint committee meeting it was pointed out by the Staff Side that the word 'new organization' of the last line of para 24 of Annexure-I of MACPS dated 19.05.2009 was not in consonance with the spirit of the Scheme. The issue has been examined and it is clarified that in case of transfer 'including unilateral transfer on request, regular service rendered in previous organization / office shall be counted alongwith the regular service in the new organization / office for the purpose of getting financial upgradation under the MACPS. However, financial upgradation under the MACPS shall be allowed in the immediate next higher grade pay in the hierarchy of revised pay bands as given in CCS (Revised Pay) Rules, 2008. Para 24 of MACPS stands amended to this extent.

3.      The Staff Side also raised an issue on the 'benchmark' for MACP as given in para 17 of Annexure-I of MACPS dated 19.05.2009, which provides that the financial upgradation would be on non-functional basis subject to fitness, in the hierarchy of grade pay within the PB-1. Thereafter for upgradation under the MACPS, the benchmark of 'good' would be applicable till the grade pay of Rs.6600/- in PB-3. The benchmark will be 'Very Good' for financial upgradation to the promotion to the grade pay of Rs.7600 and above. It was pointed out that in some cases the promotion to the next higher grade was made on the basis of 'fitness' as the method of promotion as specified in the relevant recruitment rules, was 'non-selection'. Therefore, such cases benchmarks should not be insisted upon under the MACPS. The issue has been examined and it is clarified that where the financial upgradation under MACPS also happen to be in the promotional grade and benchmark for promotion is lower than the benchmark for granting the benefits under MACPS as mentioned in para 17 ibid, the benchmark for promotion shall apply to MACP also.

4.      All Ministries/Departments may give wide circulation to the contents of this O.M. for general guidance and appropriate action in the matter.

MHRD finalizes scheme for interest subsidy for education loans

New Delhi: The ministry of Human Resource Development (HRD) has finalized the modalities for the implementation of a new central scheme to provide full interest subsidy during the period of moratorium on educational loans for students belonging to economically weaker sections (with parental family income from all sources of less than Rs.4.5 lakh annually).

The loans will be provided by scheduled banks under the Educational Loan Scheme of the Indian Banks' Association (IBA) for pursuing courses in professional or technical streams from recognized institutions in India.

The modalities have been finalized in consultation with IBA. The scheme is effective for all IBA approved educational loans sanctioned in the form of eligible students' in respect of approval course of studies from the academic year 2009-10.

"Under the scheme, proof of income is required to be certified by authorities to be designated by the state governments. Accordingly, the ministry has written to all Chief Secretaries of states and union territories to intimate the designated authority/authorities (at the district/sub-district/block etc. levels) to the District Level Consultative Committee (DLCC) so that banking authorities at the branch level where students would be approaching for availing the benefit of the scheme would be aware of the same," an official press release said.

All scheduled member banks of the IBA have also been advised to take necessary action to adopt and implement the scheme so its benefits accrue to the eligible students.

Canara Bank is the nodal bank, for the member banks of IBA, for claiming reimbursement of interests credited to student accounts.

All eligible students who wish to avail of the benefits of the scheme are advised to approach the respective bank branch from where they availed of the education loan and complete the necessary formalities.

These include obtaining the certification in respect of annual family income from the competent authority at the block, tehsil or district level, so that the individual student accounts can be credited with the interest due on the loan for the academic year 2009-10 onwards.

Most of the Inspectors from Hyderabad Zone are not aware that AICEIA has launched an agitational program and is already going on. Are we really satisfied with what we are getting. Then why our Office Bearers are not responding to AICEIA call? How many are knowing and in contact with our Hyderabad office bearers. Its time for all the Inspectors to wake up and unite to give support to our Association to achieve our goals. It is really a very tough time for our Federation Office Bearers to tackle with 'some sadist Officers' of Govt. who do not want our Inspectors to prosper. Kindly respond to this call and support our Federation. To achieve this, firstly we need to revamp our 'Hyderabad Association' immediately.

CVC Disposed of 830 Cases in October 2010 Major Penalty Proceedings Recommened Against 71 Officers
The Central Vigilance Commission disposed of 830 cases during October 2010 referred to it for advice. Of these, 573 complaints were sent for necessary action/ATR whereas 48 complaints were sent for investigation and report. No action was required on 108 complaints.


The Commission advised imposition of major penalty against 71 officers including 12 from Department of Telecommunications, 10 from State Bank of India, 6 each from Canara Bank, Department of Steel and Central Board of Excise & Customs, 4 each from New Delhi Municipal Corporation, and SPMCIL. Remaining 23 cases pertained to different departments of the Government of India and PSUs. 


Recoveries to the tune of about Rs.1.61 crore were effected after Commission conducted technical examination of some departments.

5400 GRADE PAY TO ACP INSPECTORS AND ITS EFFECT ON FUTURE GRADE PAYS

       Some of the Members have expressed doubts about granting of 5400 Grade Pay to ACP Inspectors and its effect on 3rd Financial Upgradation in view of the Govt. clarifying the NFG 5400 will be set off  against one of the MACP. Under the circumstances the following points highlighted, for discussion of the cadre:

1.  As per para 2 of MACP Scheme, the MACPS envisages merely placement in the immediate next higher grade pay in the hierarchy of the recommended revised pay bands and grade pay as given in Section 1 , Part-A of the first schedule of the CCS (Revised Pay) Rules, 2008. Thus the scheme recommends immediate next higher grade pay and delinked the grade pay of promotional post. It means there is no connection between MACP and next promotional grade therefore, what ever the immediate next higher grade pay available has to be given on MACP irrespective of whether it is immediate promotional grade or otherwise. Analyzing these aspects, it can be construed as follows:

i)            On appointment: 6500 or 4200 in PB-2
ii)          On ACP after 12/10 years 7500 or 4800 PB-2
iii)        After 4 years in 4800( ie 12/10+4=16/14 years) 5400 PB-2(we have to fight for the grade pay of 5400 in PB-3 as given to Section officers)
iv)         On completion of 20 years 6600 PB-3(ie immediate next higher grade pay available in case  NFG of 5400 is not counted as MACP)
v)           On completion of 30 years 7700 in PB-3(ie. immediate next higher grade pay available).

The above analogy is made in view of the clarification dated 29.9.2010 given by the CBEC in consultation with DOPT where it was categorically stated that the NFG of 5400 in PB-2 granted after 4 years, as well as the grade pay of 5400 in PB-3 are to be treated as separate grade pays for the purpose of MACPS.(para 8.1 of MACPS). Clarifications being made by some of the offices that MACP is required to be given from PB-2 5400 to 5400 in PB-3 is not correct, as it can be treated as only separate grade pay but not as immediate next higher grade pay.

The intention of creating 5400 in PB-2 by Pay Commission is only to upgrade the Group ‘B’ officers in 4800 after 4 years, and not as regular grade pay. It is only the Govt. which has changed it to PB-3 for some of the interested cadres.

Even as clarified by DOPT that the grade pay of 5400 given after 4 years is to be set off against one of the MACP, there is no loss to the cadre as you are going to get the grade pay after 16/14 years instead of 20 years with all the consequential benefits. Thereafter the next NFG(6600) has to be after 26/24 as stipulated in MACPS if not after 30 years as usual.

Therefore, there is only gain but not any loss under any circumstances to the cadre if NFG is granted to ACP Inspectors.
