UPDATE ON DPC

HYDERABAD DPC IS COMPLETED. ORDERS ARE LIKELY TO BE ISSUED ONLY ON MONDAY .DETAILS OF EXACT VACANCY POSITION WILL BE UPDATED AS AND WHEN RECEIVED. AS OF NOW THE LIKELY VACANCIES ARE- GENERAL:54+4(DEPUTATION VACANCIES) SC:3(BACKLOG) & ST 15(BACKLOG). THE PROMOTION ORDERS ARE LIKELY TO BE ISSUED ON MONDAY ::NO ELIGIBLE CANDIDATES FOR ST ARE AVAILABLE. THE CCA OFFICERS AGAIN MEETING ON 25.9.2010 MORNING TO COMPLETE THE PROCESS.

CHENNAI DPC UPDATE

DPC is postponed for the third time and likely to be conducted on 27 and 28 th of Sep 2010. Likely vacancies are about 84. Dossiers of Reserved Category Inspectors who have completed 8 years as on 2010 i.e. 2002 batch of Insprs are also called and being sent to CCA today from all Comm'tes. It appears that there are huge number of backlog vacancies consequent to the Kolkatta High Court outcome. Exact figures are not known. We are hoping at least the DPC be conducted on 27/28. In general Category 1991 Insprs are still waiting for promotion.

FLASH FLASH DPC INSP TO SUP BEING CONDUCTED TODAY

DPC FOR SUPERINTENDENT PROMOTION IS LIKELY TO BE CONDUCTED TODAY IE. 24.9.2010 AT 3.30 P.M. THE LIKELY PROMOTIONS ARE ABOUT 80 INCLUDING ALL CATEGORIES. THE PROMOTION ORDERS ARE ALSO LIKELY TO BE ISSUED TODAY.

THE DETAILS WILL BE PUBLISHED AFTER DPC.

Meeting with Chairman AICEIA Sec. Gen

On 23rd September 2010 Chairman took a meeting with the Association. In the meeting we have pointed out :

1. The ongoing cadre restructuring exercise and its effect
2. Notional fixation of pay of Inspectors of Central Excise in the pre-revised scale of Rs. 6500-10500 with effect from 01.01.1996.
3. Fixation of minimum pay corresponding to pre-revised scale of Rs. 7450-11500 consequent to up-gradation ordered on 13.11.2009.
4. Anomaly in pay of 1992 batch Inspectors who received ACP prior to 20.04.2004.
5. Lifting of ban on ICT
6. JCM s should be conducted at the Board level and at local level at regular intervals.
7. Abolition of control room duty.
8. The 1% incentive on incremental revenue should be utilized for providing facilities and infrastructure for lower level staffs also.
9.

Departmental Clarification on MACP.
10. Protocol duty performed by Inspectors to various higher officials and VVIP’s.
11. Non-functioning of the departmental anomaly committee
12. uniform allowance and its relevance.

Chairman gave us a very patient hearing and the meeting went on for one and half hour, Joint Secretary Sri Aabhay Singh and General Secretary Delhi Circle Sri H.S.Bajaj were there along with other office bearers. Detail of the meeting will be published through a circular within a short while.

LATEST UPDATE ON 1992 BATCH PAY ANAMOLY

LOT OF REQUESTS ARE BEING MADE KNOW THE STATUS OF 1992 BATCH INSPECTORS PAY ANOMALY. EVEN THOUGH THIS IS OLD INFORMATION, FOR THE BENEFIT OF 1992 BATCH ALL OVER INDIA THIS INFORMATION IS GIVEN.

THE CAT HYDERABAD HAS GIVEN ORDER IN FAVOUR OF 7 OFFICERS TO RECTIFY THE PAY ANOMALY VIDE OA NO. 31/2007 CLICK HERE FOR ORDER. THE DEPARTMENT HAS FILED A PETITION IN AP HIGH COURT AND OBTAINED STAY VIDE ORDER DATED 4.12.2008. THE OFFICERS HAVE THEN FILED A PETITION FOR VACATION OF STAY AND SUCCEEDED VIDE INTERIM ORDER OF HIGH COURT DATED 22.6.2009.tHE ORDER READS AS FOLLOWS:
"Heard both sides.
The application filed to vacate the interim order passed in W.P.M.P. No. 34627 of 2008, dated 4.12.2008.
The vacate petitioners filed O.A.No.31 of 2007 before the Andhra Pradesh Administrative Tribunal by order dated 13.6.2008 allowed the said O.A. Aggrieved by the same, the Department filed the present writ petition and obtained interim suspension.
Having regard to the facts and circumstances of the case, the controversy involved in the writ petition has to be decided at the time of final hearing of the writ petition. Therefore, we see no justification in continuing the interim order.
Accordingly the interim order dated 4.12.2008 in W.P.M.P. No.34627 of 2008 is vacated.
Post the writ petition for final hearing."
AFTER LOT OF DELIBERATIONS BY THE BOARD WITH DOP&T AND MINISTRY OF LAW AND JUSTICE, HAS ORDERED FOR RECTIFICATION OF PAY ONLY TO PETITIONER OFFICERS SUBJECT TO OUTCOME OF HIGH COURT VERDICT. ACCORDINGLY ALL THE OFFICERS IN THE PETITION HAVE BEEN GIVEN PAY ANOMALY AND THEIR PAY WAS RE-FIXED.

FIXATION OF PAY ON PROMOTION TO INSPECTOR CERTAIN DOUBTS

One of our comrade Sri.Praveen Kumar of Vizag has represented that he was promoted in July 2008 and he is drawing a pay of Rs. 17250. Whereas, the newly recruited Inspector on par with him is drawing Rs. 17660/-. In case the pay fixed to the newly recruited Inspector is correct, you can not get less than his pay under any circumstances. LATEST ON CADRE RESTRUCTURING

Cadre restructuring file has been cleared by the Revenue Secretary and sent to the Secretary, Expenditure. We are going to get around 4250 promotional psts of AC/DC for us which includes cascading ones also.
They are also considering the possibility of change in promotion quota prescribed for three different feeder grades at JTS level of IRS (C&CE), combined length of service of Inspector + Superintendent grade for promotion to IRS (C&CE), enhancement of promotion quota from existing 50% to 75%, promotion of Group ‘B’ Executive grades directly to Senior Time Scale in IRS (if accepted by the Government, they would give benefit of 4-5 years to the Superintendent grade officers for service rendered in Group ‘B’ Executive grade.), promotion of all the Superintendent level officers completing one & half times of qualifying service to the grade of Assistant Commissioner in IRS (C&CE)

DEVELOPMENTS IN HYDERABAD ASSOCIATION

ALL THE MEMBERS ARE AWARE THAT DURING DECEMBER 2008 SRI CC GOPI AND HIS TEAM WAS ELECTED TO OFFICE. SINCE THEN NO ACTIVITY HAS BEEN UNDERTAKEN BY THESE OFFICERS. OFF LATE IT CAME TO KNOW THAT THE SAID OFFICE BEARERS HAVE JOINED A SPLIT GROUP HEADED BY SRI KONERU PRABHAKAR RAO OF MUMBAI WHO IS TRYING TO SPLIT THE ONLY ASSOCIATION AT ALL INDIA LEVEL IN TO TWO GROUPS. ON KNOWING THE HYDERABAD OFFICE BEARERS SUPPORTING THE SPLIT GROUP, ABOUT 86 INSPECTORS HAVE SIGNED A MEMORANDUM DATED 25.11.2009 AND DEMANDED FOR IMMEDIATE GENERAL BODY AND THE SAME WAS HANDED OVER TO SRI. GOPI, GENERAL SECRETARY ON 12.2.2009. ( FOR LETTER DATED 25.11.09 CLICK HERE). EVEN AFTER 8 MONTHS NO RESPONSE HAS COME FROM THE OFFICE BEARERS. THIS IS THE RESPECT THEY SHOW TOWARDS THE MEMBERS WHO ELECTED THEM.

APART FROM THIS THE DDO CERTIFICATES COLLECTED FROM YOU AUTHORISING TO DEDUCT ASSOCIATION SUBSCRIPTION TO AICEIA HAVE NOT BEEN SUBMITTED TO OUR ALL INDIA BODY SO FAR. IT IS UNDERSTOOD THROUGH RELIABLE SOURCES THAT THE SAID DDO CERTIFICATES HAVE BEEN HANDED OVER TO THE BREAKAWAY GROUP WITHOUT ANY PERMISSION OF THE MEMBERS. IF THIS IS CORRECT, THE OFFICE BEARERS ARE LIABLE TO DISCIPLINARY ACTION UNDER CONDUCT RULES. THE ALL INDIA BODY OF AICEIA HAS ALREADY INITIATED THIS PROCESS. PLEASE REMEMBER THERE IS NO RECOGNITION TO THIS BREAKAWAY GROUP AND THEY ARE TRYING TO GET THEIR RECOGNITION THROUGH BACKDOOR WITH YOUR DDO CERTIFICATES WHICH WERE SUBMITTED TO AICEIA.

Request for EARLY d.p.c.

Sub: Stay on promotions ordered by Calcutta High Court – Reg

A kind reference is invited to our letter 23.07.2010 and 30.08.2010 on the above subject.

Despite our repeated requests for directing the cadre controlling authorities to conduct and keep the results of DPC s ready, no directions has been issued by the Board. It doesn’t require much elucidation to bring home the point that such an act on the part of the Board would have brought a scrap of confidence among the employees who are waiting for their first promotion for more than 2 decades. We regret to point out that the promptness shown in communicating the stay gets entangled in red tape when the lifting of the stay is required to be communicated.

The interim order of Calcutta High Court issued on 27.08.2010 has now been published in Court Website and we request that the issue may not be procrastinated further by insisting on a certified copy. (which is already issued and in care of Kolkata Chief Commissioner)

In terms of the interim order, the only condition precedent for issuing the regular promotion order is the issuance of order consequent to the review of DPC held on 09.09.2004 in Kolkata Commissionerate. Hence we submit that the most effective way in hastening the matter would be to fix a time frame for Kolkata CCA for issuing the orders consequent to review DPC and a date for all CCA s to issue orders in the zone, rather that waiting for a compliance report from Calcutta to issue directions to other CCA s. I.e. if the final date fixed for Kolkata CCA to issue order is 10.09.2010, other CCA s may be required to issue order on 13.09.2010. We would like to reiterate that the date of effect of the promotion orders should at least be from 01.07.2010.

We also wish to highlight the fact that already several officers who were in line for promotion in the calendar DPC have retired during the month of July and August there by losing out on their pension benefits and social status. Hence we request that the directions in terms of the preceding paragraph may be issued immediately so that the similar officers retiring in this month at least would be saved.

Child Care Leave for Central Government employees - Clarification

Office Memorandum

Sub: Child Care Leave in respect of Central Government employees as a result of Sixth Central Pay Commission recommendations - Clarification regarding

The undersigned is directed to say that this Department has been receiving representations from Government Servants through various quarters like the Public Grievances Cell/Associations etc requesting to review the decision to allow Child Care Leave (CCL) only if the employee has no E.L. at her credit.

2. This Department's O.M. No.13018/2/2008-Estt.(L) dated 11/09/2008 regarding introduction of Child Care Leave in respect of Central Government employees and subsequent clarifications vide O.Ms. dated 29/9/2008, 18/11/2008 and 2/12/2008 were reviewed.

It has now been decided in consultation with Department of Expenditure, to delete the condition that CCL can be availed only if the employee concerned has no Earned Leave at her credit, subject to the following conditions:-

(i) CCL may not be granted in more than 3 spells in a calendar year.

(ii) CCL may not be granted for less than 15 days.

(iii) CCL should not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which this leave is sanctioned during probation is minimal.

3. It is reiterated that the leave is to be treated like Earned Leave and sanctioned as such.

4. These orders take effect from 1.9.2008. Earned Leave, if any, availed by women employees before availing CCL subsequent to the issue of the OM 13018/2/2008-Estt.(L) dated 18/11/2008 may be adjusted against CCL, if so requested by the employee.

BUT THE ORDER CLEARLY STATES THAT
" It is made clear that the decision of the review DPC of 9th September, 2004 should be given effect to by considering the effect of such DPC from 2nd July, 1997 and on that basis promotion orders to be issued and further promotion could be dealt with.

It is further made clear to avoid any confusion that first promotion order to be made on the basis of review DPC of 9th September, 2004 and thereafter further promotion of candidates under all India zones would be considered."

SOME PEOPLE HAVE EXPRESSED DOUBTS THAT THE ORDER MEANS, UNTIL THE FIRST PROMOTION ORDER FROM CALCUTTA ZONE ISSUED AFTER CONDUCTING REVIEW DPC AS ORDERED BY THE HON'BLE COURT, NO PROMOTION CAN BE ISSUED IN ALL ZONES. BUT IT IS NOT CORRECT IN MY VIEW.
THE SENTENCE "thereafter further promotion of candidates under all India zones would be considered." THIS ORDER HAS TO BE READ WITH IN CONJUNCTION WITH THE EARLIER INTERIM ORDER WHERE IT IS SAID THAT " considering the situation, this court is of the view that from this date date there should not be any order of promotion in the concerned promotional post of superintendent and to further promotional post of asst. commissioner in the concerned hierarchy without leave of the court" THERE IS NO INSPECTOR IN ALL INDIA ZONE, IT IS ONLY SUPDTS. THAT ARE IN ALL INDIA ZONE, THEREFORE, THERE IS NO RESTRICTION FOR GIVING PROMOTION TO INSPECTORS IN OTHER ZONES.

FM asks CBDT, CBEC to wrap up AGTs by April; set up panel for litigation management and common risk management institution

MUMBAI, SEPT 02, 2010: WHILE addressing the large gathering of revenue officials at a revenue review meeting here yesterday, the Union Finance Minister, Mr Pranab Mukherjee, once again hammered home the point to both the Revenue Boards to improve the human resource management to meet the rising expectations of the officers and the staff. He said that though there has been some improvement pertaining to Departmental Promotion Committee (DPCs) for the staff and officers, but still it is not satisfactory. It should be ensured that DPCs are held well in advance to keep the employees motivated and eager to perform their responsibility in the service of the Nation.

''I would like to see that a model time frame for conducting the DPC is developed and followed strictly. Both the Departments should aim to become a model employer, which provides equal opportunities and equity in true sense. I have noticed that transfer orders of the officers are issued in mid of the year, which affects not only the officer, but also the Department. The officer has to shift his family and children in the mid of the academic session, which causes avoidable mental stress. Similarly, by shifting of the officers in the mid of the year from one charge to the other charge, the continuity and time available is reduced considerably. This adversely affects achieving the targeted revenue. This can be avoided by ensuring that all the annual general transfers are carried out by both the Boards by the 2nd week of April. The regional orders by the respective Chief Commissioners should be completed by the end of April of every financial year. This will reinforce the confidence of the employees in our system and we can demonstrate by action that we actually care for our employees. I am confident that both the Board can calibrate their long term human resource policies to achieve the above objectives,'' he emphasised.

The FM also said that the Cadre Restructuring for CBDT was done in the year 2001 and for the CBEC in the year 2002, which is to be reviewed after every five years and is overdue. He emphasised that this needs to be expedited and completed in a time bound manner. There is also a need to develop a system to make it as a continuous process and not as an event to meet the legitimate expectations of the Officers and staff.

For litigation management the FM asked both the Revenue Boards to constitute Standing Committee at the level of Chief Commissioners to have a systematic bottom to top approach. Expressing concern over Central Excise and Customs duty arrears in the zone, Mr Mukherjee asked the officers to give special emphasis in taking some serious steps for collection of arrears of revenue. The Finance Minister urged the revenue department to create a formal Risk Management institution to improve the voluntary tax compliance in India. There is a need to create a formal Risk Management institution to handle the critical component of tax governance on a real-time basis. Both the departments can collaborate on the issue of risk management to further improve the voluntary tax compliance in India.

The FM said that litigation management is an area of concern which both Departments need to look into to create an atmosphere of trust and mutually beneficial relationship with tax payers as well as revenue officials. Departments are filing appeals in a routine manner without careful thought and examination. ''I have noticed that some of the appeals filed have been dismissed by the courts on account of gross delays. For this I have constituted a Standing Committee in both the Boards. This Committee will identify systematic causes for service litigation and litigation with tax payers and will prepare a road map for reducing the existing litigation and to avoid litigation in future. This Committee has been constituted at the Board level. I will encourage both the Boards to constitute a similar Standing Committee at the level of Chief Commissioners to have a systematic bottom to top approach for litigation management. This would lead to manageable number of cases before the Courts, which can be defended efficiently and will enhance the success rate in litigation,'' he stressed.

Mr Mukherjee asked the officers to give equal importance in collection of arrears of revenue. ''I find that in this Zone an amount of around 3,088 crores is locked up in respect of Central Excise arrears, and an amount of around 1,740 crores in respect of Customs duty arrears. We are now in the beginning of 6th month of the Financial Year. It is high time that we give special emphasis in taking some serious steps for collection of arrears of revenue,'' he added.

Another area where the situation is rather alarming is pendency of adjudication. The FM said that the delay in adjudication ultimately results in delay in collection of revenue due to the Government. In Mumbai Zone alone, an amount of around Rs 2,192 crores of Central Excise duty, an amount of around Rs 1,931 crores of Customs duty, and an amount around Rs 3,800 crores of Service Tax are locked up in the pending adjudication cases.

While reviewing the revenue collections trend, the FM expressed his happiness with the trend. He said that ''I find that for the period of four months i.e. from April to July in this financial year, the Customs revenue collection in three Mumbai Zones has registered an average growth of 79.5 percent compared to the collection during the corresponding period of last financial year. In Central Excise also there has been buoyancy, though the growth has been slightly less as compared to Customs. I find that the two Central Excise Zones in Mumbai have an average growth of 55.65 percent compared to the collections during the corresponding period of last financial year. This trend of revenue realization would not only need to be maintained but also to be improved during the coming months so that if there is any shortfall in other area, collections from this Zone can help us in filling the gap.''

The manufacturing sector in the country is looking up and this has contributed in not only increased Central Excise duty but also increase in the imports of capital goods, machinery and other raw-materials which has in turn resulted in increase in Customs revenue collection. In Service Tax, however, Mr Mukherjee said that the growth is much less. It is only about 8 percent. This defies logic as to why the growth of Service Tax should be so small. It is an acknowledged fact that the service sector in the country is also growing substantially. He asked the officers concerned with the Service Tax collection to ponder over this, and find ways and means to increase the Service Tax collections.

On the direct tax side, the net corporate tax has shown a growth 20.9% and personal income tax a growth 8.51% with overall growth for direct taxes at 15.75% as on 31st July 2010. The overall direct taxes growth is satisfactory. But the collection of direct taxes from Mumbai is below the national average, Mr Mukherjede said, adding that the achievement of direct tax collection largely depends upon collection from Mumbai. Therefore, revenue collection should be monitored effectively and special efforts should be made to achieve not only the budgeted target but also to exceed it.

The major area of concern on the direct tax side is the revenue locked up in appeal. Rs 28,046 crores is blocked in appeal before CIT (Appeal) and Rs 10,010 crores before ITAT.

The FM observed that for Mumbai, there has been an increase in advance tax, for the financial year 2010-11 by 22% in comparison to the same period of the previous year. The tax deducted at source for the current financial year has shown a decline by almost 2% in comparison to the corresponding period of the previous year. The trend in TDS collection, which is a major source of revenue to the government exchequer should be analysed to ensure that taxes due from TDS are collected, he added.
